Today, the Agricultural Marketing Service (AMS) published a document to correct the effective date in the Organic Livestock and Poultry Standards (OLPS) final rule (88 FR 75394), which was published on November 2, 2023. The new effective date for the OLPS final rule is January 12, 2024.

This change is necessary to meet requirements of the Congressional Review Act (CRA) whereby agencies must give Congress at least 60 days to review a major rule before it becomes effective. AMS notified Congress of the OLPS final rule on November 13, 2023, but the original effective date of the rule was January 2, 2024. Therefore, the published effective date did not provide the required 60 days for Congressional review. The document published today corrects the effective date to meet the requirement.

The change to the effective date does not affect the compliance dates published on November 2, 2023. However, AMS is updating one compliance date that was incorrectly published as January 5, 2029, in the OLPS final rule. The corrected compliance date is January 2, 2029. This adjustment aligns the compliance date for broiler operations with the compliance date for layer operations. All other compliance dates published in the OLPS final rule remain unchanged.

Because this document only corrects the effective date and one compliance date in the OLPS final rule, NOP is not soliciting public comment.
