National Organic Program: Market Development for Mushrooms and Pet Food

The National Organic Program published the final rule for both Mushrooms and Pet food in December with an effective date of February 21, 2025 and a compliance date of February 22, 2027. This publication was quickly followed by a notice of postponement until March 21, 2025. Now, the USDA published a proposed rule to rescind the regulation. The proposed rule had a short 30 day window for public comments that closed June 11. MOSA has paused implementation of the final rule until we know the outcome of this new proposed rule. Stay tuned!

MOSA Notice to Certified Importers: MOSA is working with our inspectors to clarify audit trail documents needed to verify organic integrity of imported organic products. Please be prepared to have the following information available for your inspectors to review: OR1 and OR2 reports, generated through the ACE system of the U.S. Customs and Border Protection - these can be requested from your customs broker if you are using one, Electronic NOP Import Certificates for all products imported during the last year, and current Organic Certificates for all imported products, in English. Your Organic System Plan should clearly explain your Control System for verifying that imported organic products are clearly identified and marked as organic on all import documents including but not limited to invoices, packing lists, bills of lading and US Customs and Border Protection entry data. Additionally, your documented control system should explain how you verify that each shipment has had no contact with prohibited substances or exposure to ionizing radiation treatment, since export, in accordance with 205.273 Imports to the United States.
